Criminal law – murder committed with intent in the form of dolus eventalis –
having regard to the nature, extent and circumstances of assault on deceased – the
only reasonable inference to be drawn is that appellants subjectively foresaw that their
conduct could result in the deceased’s death but were reckless as to such consequence
– appeal dismissed.
